Resolved Question: If my dad gets custody of me, is there any way to live with my mom, can I legally divorce him?

3 August 2010, 7:06 pm

I am 15 years old and I want to live with my mom, but my dad is fighting my mom relentlessly to get custody over me (In the court and in real). My mom has custody over me and my sisters. I was living with my mom until two years ago. My dad moved to California with my two sisters because my mom and him made an agreement that he would move out and, once mom finished fixing up her house in Connecticut she would move out there to be closer to the other kids. I came to visit him about three months after he left and he convinced me to go to school there until mom finished her house and moved out. Let me say one thing: the year and a half I spent with him were absolute hell. I really wanted to live with my mom after about a month of living with them, but every time I said so, he said that I had to finish the school year first. I came to visit mom during the summer and didn't want to go back. but I ended up having to go because dad had already signed me up for school and I was expecting mom to finish the house very soon. It ended up taking 3 more months or so for her to finish and when she was finally done with the house, as per dad and her agreement, he was supposed to help her pay for it, but he didn't give her nearly enough to move across the United States. Mom had to save up her money for another 2 months in order two have enough to come out to California. When she finally made it to California and found an apartment (she couldn't afford a house because this was Simi Valley) and he wouldn't co-sign for it even though he had agreed to help her move out. So she moved to San Jacinto, because all her family was out there and we went out to live with her... dad didn't like that. He had formerly promised me and my sisters that he wouldn't take my mom to court, he lied. Then to top it all off he started using dirty tactics in order to take custody of me and my sisters. Just recently he exparte'd my mom and only gave her one day notice of the court date. He now had custody over us until the 12th but I really don't want to see him, is there anything I can do about this? Also I am very worried that he might win this court case and get custody, if this happens is there anything I can do? Am I old enough to legally divorce him? What do i have to do? I have a half brother at my mom's and don't want to be separated from him again. And I have a mom that loves me to death and if he wins I'll only see her once every two weeks. I don't want that. He and his wife have mentally and physically abused me and also, my mom has no lawyer, she cant afford them and she doesn't believe in them... Read More »
